By accessing and using the M2Fitness application and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
2. Description of Services
M2Fitness provides online fitness and nutrition coaching services through the M2Fitness application, which is provided by and in conjunction with ABC Trainerize. Our services include, but are not limited to, personalized workout plans, nutritional guidance, and access to our mobile application features.
3. User Accounts and Application
3.1. To use our Services, you must create an account and download the M2Fitness application after successful payment.
3.2. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3.3. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4. User Responsibilities
4.1. You are solely responsible for your interactions with other users of the Services.
4.2. You agree to use the Services only for lawful purposes and in accordance with these Terms.
4.3. You acknowledge that the fitness and nutritional advice provided through our Services is not a substitute for professional medical advice, diagnosis, or treatment.
4.4. You understand and agree that all training is done on an individual basis and not under the direct supervision of a coach or trainer.
5. Intellectual Property
5.1. All content, features, and functionality of our Services are owned or leased by Macros to Muscles, Ltd. DBA M2Fitness and are protected by copyright, trademark, and other intellectual property laws.
5.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our prior written consent.
6. Payment and Subscriptions
6.1. Certain Services may require payment of fees. You agree to pay all fees associated with the Services you select.
6.2. Subscription fees are billed in advance on a recurring basis. You may cancel your subscription at any time, but no refunds will be provided for any unused portion of the current billing period.
7. Termination
We reserve the right to terminate or suspend your account and access to the Services at our sole discretion, without notice, for any reason, including breach of these Terms.
8. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied.
9. Limitation of Liability
To the fullest extent permitted by law, M2Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
10. Indemnification
10.1. You agree to indemnify and hold M2Fitness harmless from any claims, losses, or damages, including legal fees, resulting from your violation of these Terms or your use of the Services.
10.2. You expressly agree that M2Fitness is not responsible for any physical injury sustained by you during training at home or in someone else's gym. You acknowledge that you are training without direct supervision of a coach or trainer and assume all risks associated with such training.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any significant changes by posting a notice on our website or within the M2Fitness application.
